​9.4 If Niompay or substantially all of the company’s assets are acquired by a third party, in which case personal data held by the company about our customers will be one of the transferred assets;

​9.5 If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our various terms, policies and other agreements; or to protect the rights, property, or safety of Niompay, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

10.0 Storing and securing your information

​We have in place a level of security appropriate to the nature of the information stored and the harm that might result from a breach of security. Your information is stored on our secure servers in the United Kingdom., for further information, please refer to our FAQ’s.

The information that we collect from you may also be transferred to other destinations outside the European Economic Area (“EEA”), including the United States of America, where it will be stored by us or by one of our suppliers. It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such suppliers and staff may be engaged in, among other things, the provision of support services. Your personal information may be transferred to other countries for processing, which may have different personal data protection rules than in your country. Where we transfer your data outside the EEA, we ensure adequate protection remains in place, including through the use of EU model clauses.

​We may provide links to other websites via our website, if we do so then we cannot be held responsible for the other sites privacy policy as they will hold their own specific to them, this also applies to site content, practices they carry out and the services and products they may offer, all of which we cannot take any liability for.

12.0 Your rights

​The Data Protection Act 1998 gives you the right to access information we hold about you. Your right of access can be exercised in accordance with the Act.

You have the right to ask us not to process your personal information for marketing purposes. If you would like to exercise your right to prevent such processing, you can do so by clicking on any “Unsubscribe” link in our emails and following the instructions or by getting in touch with us using our contact details in paragraph 18.

​Please note that you cannot opt out of communications from us concerning the administration or security of your account with us, or any transactions relating to such account, or any other essential communication concerning the administration, safety and security of our services.

13.0 Changes to your information

Alternatively, if you believe that any of the information we hold about you is inaccurate, you may contact us to correct it using our contact details at bottom of paragraph 18. It is your responsibility to ensure that any information you have provided to us remains accurate and to notify us if there are any changes.

14.0 No Waiver

​If we fail to exercise, or delay in exercising, any right or remedy contained in this Privacy Policy, that does not mean we have waived that right or remedy and such failure or delay shall not be construed as a waiver.

15.0 Severance

​This Privacy Policy is designed to comply strictly with the Data Protection Act 1998 and other applicable data protection laws. However, in the event that any provision or part-provision of this Privacy Policy is or becomes unlawful, invalid or otherwise unenforceable, the offending provision or part-provision shall be deemed severed from this Privacy Policy. In this event, the validity and enforceability of the rest of the Privacy Policy shall not be affected.

Niompay uses cookies to assist us analyze the traffic on our site and customer behavior. Cookies may also be used by our partners to understand marketing and traffic patterns. Whilst visiting our website cookies with any pages that you choose to view will be downloaded onto your computer. Cookies are a good way of helping us by being used as a measuring tool to assess our visitors and their own profiles, this will then enable us to offer our customers a better service. Although we use cookies as above we would not store anything that would make the customer identifiable i.e. passwords or locations, activity relating to finances and also their preferences. We also use customer information in order to assist us to see how effective our website is and also to highlight any improvements we may need to make. This information may in turn be passed to other businesses (third parties) purely for advertising reasons. Please be assured again that this information will not include personal information that can make customers identifiable.
